Elite Power Solutions, LLC (EPS)

This Privacy Policy for EPS Products and Services (“Product Privacy Policy”) describes information that EPS collects, uses, shares, and stores, including personal information (i.e., information that personally identifies you, such as your name, email address, or other data that can be reasonably used to infer this information).

This document focuses on information related to the operation of the EPS battery management system (“EPS EMS”). In this Product Privacy Policy, the expression “EPS Products” also includes our Web Apps and Mobile Apps.

Elite Power Solutions LLC. built the EPS EMS Android/iOS app as a commercial app. This SERVICE is provided by and is intended for use as is. If you choose to use our service, then you agree to the collection and use of information in relation to this policy. Elite Power Solutions does not intentionally collect Personal Information. User email address is the only information collected at this time. The Privacy Policy will be updated if Elite Power Solutions intends to collect more user information in the future. The user email is stored to provide and improve rendered services. Elite Power Solutions will not use or share your information with anyone except as described in this Privacy Policy.

Note:  You can use any email accounts to login to the EPS EMS app. For example, if you use your EPS Products and services with a Google Account, then your data will be handled as described in the Google Privacy Policy, and as explained in more detail in this Privacy FAQs Help Center page. Please also read Google’s commitment to privacy in the home.

What information does EPS EMS collect and store when a user connects an EPS EMS to the Internet or creates an account?

Bluetooth and Location

 

For a better experience, while using our service, we may require you to provide us with certain personally identifiable information, such as Location depending on the operating system you are using. The Location information is solely used to provide Bluetooth services as some Android versions of Bluetooth do not work if the device Location is disabled. The Location information is neither stored nor transmitted to any servers by EPS EMS application.

If you are using Android 11 or lower (SDK level less than 31) , the EPS EMS app will ask for fine location permission in order to fully access Bluetooth. This permission is required as mentioned in the link above to discover bluetooth devices.

If you are using Android 12 or above (SDK level larger than or equal to 31) , the EPS EMS app will ask for Bluetooth connect and Bluetooth scan features only to discover and connect to new and paired devices.

 

The app is hosted on Google Play, a third party service that may collect personally identifiable information. Link to the privacy policy of third-party service providers used by the app:

Wi-Fi Network Information

To connect an EPS EMS to our services, or to access your EPS EMS over the Internet from a computer, a smartphone or a tablet, you will need to connect it to a Wi-Fi network. During setup, the EPS Product will ask for your Wi-Fi network name and password to connect to the Internet. It will save this information on the device, along with your IP address, so that you can access it and control it from your computer, smartphone or tablet, and so that it can communicate with EPS servers and download software updates.

Once connected to your Wi-Fi network, your EPS Product regularly sends the data described in this statement (excluding your Wi-Fi password) to EPS to provide you with these services.

Basic user information

In order to use the EPS EMS mobile app, a user must first register for an account. Your account asks you to provide certain basic profile information like your name and email address. A password is needed to complete the account setup. EPS cannot recover the passwords as they are encrypted in the backend database. The user can reset the password if the option is available on the login screen. If you download the EPS Mobile App, we may collect and store your mobile device identifiers.

Technical information from the device

If you add new devices or change settings on the EPS EMS app, it records and feeds that information to the Google cloud server. Every time your system turns on and off, EPS EMS records the time and duration and all battery system parameters during which your system was on in order to offer you features such as usage trends and history. In order to improve your experience over time and help troubleshoot any problem you may encounter with the your battery system, EPS EMS records your system model and serial number, software version, and technical information such as battery charge level.

How does EPS use the information it collects?

We use this information to provide, develop and improve EPS Products and services, including making assessments and recommendations about products, safety, or energy use. We may use your contact details to send you this information, or to ask you to participate in surveys about your EPS use, and to send you other communications from EPS.

We do not share a customer's data with anyone outside of EPS. But we may use this information in a non-identified form for research purposes and to help us make sales, marketing, and business decisions.  

We will use customer’s historical battery data such as usage history, alarm limits, minimum/maximum voltages and temperatures as well as capacity, in the determination of warranty claims made against any of EPS’s products.

We use industry-standard methods to keep this information safe and secure while it is transmitted over your home or business network and through the Internet to our servers.  

EPS cannot be held responsible for security issues that arise from home or business networks. The EPS EMS is able to connect to open, unsecured, Wi-Fi networks; however, this practice is not recommended for security reasons.

In what circumstances does EPS share information?

Under no circumstance do we share personal information for any commercial or marketing purpose unrelated to the activation and delivery of EPS Products and services without asking you first. We do not rent or sell our customer lists. The following are the limited situations where we may share technical information:

We have distributors, sales representatives, engineers and technicians who help with some of our processing and storage including helping to answer your questions. They may also assist with monitoring our servers for technical problems. These technicians (as well as EPS employees) can access certain information about your account in line with this work but these technicians are not allowed to use this data for non-EPS purposes. We also have strict policies and technical barriers in place to prevent unauthorized employee access to your data.

We may share non-personal information publicly and with our partners. This information may also be shared with other users to help them better understand their battery usage compared to others in the EPS community, raise awareness about safety issues, or help us improve our products. 

If you select an outside party for the purchase, installation or service of your EPS device and share your information, we cannot control the collection, storage or sharing of information collected by that party. Or the party that installed the device may retain information that you provided to them to assist them in servicing the device if needed. Always check the privacy policies for any company that collects your information.

We may disclose information in response to legal process and lawful requests by public authorities in the United States and other countries for the purposes of law enforcement and national security.

What is the responsibility of a maintenance user?

Note: Maintenance level access is not provided to all users.

1.        EPS distributors can generally request Maintenance user access.

2.        Maintenance users have access to the System Setup and Maintenance Parameters.

3.        Maintenance users or their affiliates assume total responsibility for configuring the EPS EMS CPU system.

4.        Maintenance users understand that changing the System Setup or Maintenance Parameters will affect the functioning of the EPS EMS CPU system.

5.        Unless reviewed and approved by EPS, maintenance users assume full responsibilities when modifying safety-related parameters, such as alarm limits, from their default values. A review of such parameters is not compulsory and must be requested.

6.        Maintenance users are humans and can cause human errors, which may lead to damages. EPS is not responsible for damages caused by human-errors, ignorance, stupidity, operating under the influence of drugs/ substances that impair the person's ability to function safely.

Who is an authorized user?

Only individuals aged 18 and older are permitted to act as owners of EPS EMS Accounts.  Authorized Users must be over the age of 13 and may use the Products and Services under the supervision of a parent or legal guardian and only if they agree to be bound by these Terms on their behalf. EPS Products and Services do not knowingly collect or store any user information from anyone under the age of 13.

How EPS EMS software version is updated?

1.        EPS EMS software is updated over-the-air by EPS, the user agrees to receive the latest software update.

2.        Android/ iOS apps are updated by EPS, the user agrees to update the applications.

3.        Updates to the EPS EMS system are installed automatically and may require the app to be updated in order to retain full functionality or work with new features.

How secure is EPS EMS data?

EPS aims to keep its products, apps, and websites safe for everyone, and data security is very important to us. To that end, here’s some information about EPS data security to share with you:

1.        EPS strives to ensure the safety and accuracy of all the applications but Android / iOS apps are for display purposes only and EPS is not responsible for any damages caused by the non-functioning of these applications.

2.        Unexpected cloud downtime may occur causing the applications to show stale / old data, EPS is not to be held responsible for such inaccuracies.

3.        While EPS strives to keep hackers / intruders / non-EPS-personnel at bay, EPS is not to be held responsible for any damages caused by such incidents.

4.        EPS EMS runs on a third-party operating system, while EPS strives to ensure the safety and functioning of the operating system and its applications, EPS is not responsible for damages caused by the non-functioning of the system. A third-party operating system refers to a software that is not developed or maintained by EPS personnel.

Data security is a priority at EPS. If you are a security researcher or EPS Products customer and think you’ve found a security issue or vulnerability, we appreciate your help in disclosing it to us in a responsible manner. Please don’t access or modify data without permission, and act in good faith not to degrade the performance of our products, apps, and websites.

If you believe you have discovered a vulnerability or have a security incident to report, let us know. Please include a detailed description of the possible vulnerability and an email address where we can reach you in case we need more information. We'll work to assess your report as quickly as possible. 

Can the Product Privacy Policy be changed?

Please note that this Product Privacy Policy may change from time to time. We will provide notice of any changes.
